Table of Contents

Welcome to GRAIL (“GRAIL,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the GRAIL platform, including our website, marketplace, applications, services, rewards program, and any related features (collectively, the “Platform”).

By creating an account, accessing, or using GRAIL, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.

These Terms are intended to protect buyers, sellers, collectors, and GRAIL while maintaining a fair, secure, and trustworthy marketplace.

1. Eligibility

To use GRAIL, you must:

  • Be at least eighteen (18) years old or the age of legal majority in your jurisdiction, whichever is greater.
  • Have the legal capacity to enter into a binding agreement.
  • Provide accurate and truthful registration information.
  • Comply with all applicable local, state, federal, and international laws.

You may not use GRAIL if:

  • Your account has been suspended or terminated by GRAIL.
  • You have previously violated these Terms and have not been expressly authorized to return.
  • Your use of the Platform would violate applicable law.

GRAIL reserves the right to request additional verification of identity or account information at any time.

2. Marketplace Role

GRAIL is an online marketplace.

GRAIL is not the owner or seller of most items listed on the Platform.

Except where explicitly stated otherwise:

  • Sellers are responsible for their listings.
  • Buyers are responsible for their purchasing decisions.
  • GRAIL facilitates transactions, payment processing, communication, dispute review, and marketplace operations.

GRAIL does not automatically inspect, authenticate, grade, or verify every item listed on the Platform.

Any future authentication, verification, vault, or concierge services offered by GRAIL will be governed by their own applicable policies.

3. Account Responsibility

You are responsible for maintaining the security of your account.

You agree to:

  • Keep your login credentials confidential.
  • Use a secure password.
  • Promptly notify GRAIL of unauthorized account access.
  • Maintain accurate account information.

You are responsible for all activity occurring under your account unless prohibited by applicable law.

You may not:

  • Share accounts.
  • Sell or transfer accounts.
  • Create accounts using false identities.
  • Impersonate another individual or business.
  • Circumvent suspensions or enforcement actions by creating additional accounts.

4. Accurate Information

All information submitted to GRAIL must be truthful, accurate, and complete.

This includes:

  • Account information
  • Listing information
  • Card details
  • Images
  • Certifications
  • Shipping information
  • Payment information

Knowingly providing inaccurate or misleading information may result in:

  • Listing removal
  • Offer cancellation
  • Reward forfeiture
  • Trust Score reduction
  • Account suspension
  • Permanent account termination

depending on the severity and frequency of the conduct.

5. Buying and Selling

All marketplace purchases must be completed through GRAIL’s Protected Checkout.

Users may not intentionally attempt to avoid marketplace fees by arranging off-platform payment or transactions after connecting through GRAIL.

Listings must accurately represent the item being sold, including where applicable:

  • Player or character
  • Year
  • Brand
  • Set
  • Card number
  • Condition
  • Grading company
  • Grade
  • Certification number
  • Images
  • Known defects

Listings must not intentionally omit material information that would affect a reasonable buyer’s purchasing decision.

6. Buyer Payment Obligations

When a buyer commits to purchase an item through Buy Now, accepted offer, auction win, or any other purchase flow supported by GRAIL, the buyer agrees to complete payment promptly.

Unless otherwise specified by GRAIL, buyers are expected to complete payment within twenty-four (24) hours.

Failure to complete payment may result in actions including:

  • Cancellation of the transaction
  • Trust Score reduction
  • Temporary purchasing restrictions
  • Account suspension
  • Permanent removal from the Platform for repeated abuse

GRAIL may determine appropriate enforcement based on the circumstances of each case.

7. Seller Responsibilities

Sellers agree to:

  • Ship sold items promptly.
  • Accurately describe listed items.
  • Package items appropriately.
  • Comply with applicable shipping requirements.
  • Respond honestly during disputes.
  • Cooperate with GRAIL investigations.

Sellers remain responsible for the accuracy of every listing they publish.

8. Seller Cancellations

GRAIL recognizes that circumstances may occasionally require a seller to cancel a listing or transaction. However, excessive or abusive cancellations negatively affect marketplace trust and buyer confidence.

Active Fixed-Price Listings

A seller may end an active fixed-price listing at any time before a completed purchase.

Ending a listing returns the item to the seller’s collection unless the seller chooses to remove it from GRAIL.

Active Auctions

Active auctions with no bids may be cancelled by the seller at any time.

Once an auction has received one or more valid bids, the seller may not cancel the auction through the normal marketplace tools.

Attempts to avoid completing an auction after bidding has begun may result in enforcement actions.

Completed Sales

After a buyer has completed payment, sellers may not unilaterally cancel a completed transaction.

If exceptional circumstances require cancellation, the seller may submit a cancellation request through GRAIL.

Each request will be reviewed individually.

If GRAIL determines that the cancellation was unnecessary, abusive, fraudulent, or otherwise inconsistent with marketplace integrity, GRAIL may:

  • Reduce the seller’s Trust Score.
  • Remove rewards or promotional benefits.
  • Restrict selling privileges.
  • Suspend or terminate the seller’s account.

Repeated cancellations may result in permanent removal from the Platform.

9. Listing Standards

Every listing published on GRAIL must accurately represent the item being offered.

Sellers may not intentionally publish listings that contain false, misleading, incomplete, or deceptive information.

This includes, but is not limited to:

  • Incorrect card names.
  • Incorrect years.
  • Incorrect sets.
  • Incorrect card numbers.
  • Incorrect player or character information.
  • Incorrect grading information.
  • Incorrect certification numbers.
  • Misleading photographs.
  • Misleading descriptions.
  • Concealed damage or alterations.

GRAIL reserves the right to remove or edit listings that fail to meet marketplace standards.

Repeated inaccurate listings may result in Trust Score reductions, listing restrictions, suspension, or permanent account termination.

10. SportsCardsPro Market Values

Where available, GRAIL may display market value information obtained through SportsCardsPro or other third-party valuation providers.

These values are provided solely as informational estimates.

Market values:

  • Are not guaranteed sale prices.
  • Do not represent an appraisal.
  • May change at any time.
  • Should not be interpreted as investment advice.

Market values displayed by GRAIL may only originate from supported marketplace integrations.

Users may not manually manipulate, falsify, or intentionally misrepresent verified market values.

Knowingly attempting to circumvent market value verification, including intentionally matching incorrect cards or manipulating listing information to obtain an inaccurate valuation, may result in:

  • Removal of the listing.
  • Removal of GRAIL Tag eligibility.
  • Trust Score reduction.
  • Suspension.
  • Permanent account termination.

11. Investment and Financial Disclaimer

Market values are provided for informational purposes only. Nothing on GRAIL constitutes financial, investment, tax, or legal advice. Users remain solely responsible for evaluating purchases and sales, including the risks of buying, selling, holding, or trading collectibles. Collectibles may increase or decrease in value, and past prices or estimated values do not guarantee future results.

12. GRAIL Credit

GRAIL Credit is promotional marketplace credit issued by GRAIL.

GRAIL Credit:

  • Has no cash value.
  • Is not legal tender.
  • Is not redeemable for cash.
  • Is non-transferable.
  • May not be sold.
  • May not be exchanged.
  • May only be redeemed through eligible purchases on GRAIL.

GRAIL Credit does not represent a bank account, stored cash balance, or financial account.

Unused GRAIL Credit does not expire unless otherwise announced by GRAIL.

GRAIL reserves the right to modify, suspend, discontinue, revoke, adjust, or terminate GRAIL Credit at any time.

This includes individual accounts or the entire rewards program.

GRAIL Credit may be reduced or removed if GRAIL reasonably determines that credit was obtained through:

  • Fraud.
  • Abuse.
  • Marketplace manipulation.
  • Multiple-account abuse.
  • False transactions.
  • Listing manipulation.
  • Terms of Service violations.
  • Reward exploitation.
  • Any activity intended to improperly obtain promotional benefits.

GRAIL may also reverse previously issued GRAIL Credit where appropriate to protect the integrity of the Platform.

13. Rewards Program

The GRAIL Rewards Program is a promotional loyalty program offered at GRAIL’s sole discretion.

Participation in the rewards program does not create any vested property right.

Reward structures, earning percentages, eligibility requirements, membership benefits, promotional events, GRAIL Credit awards, reward tiers, and related benefits may be:

  • Modified.
  • Suspended.
  • Expanded.
  • Reduced.
  • Replaced.
  • Discontinued.

at any time without prior notice.

GRAIL Pass membership benefits, reward boosts, visibility opportunities, perks, and promotional features may change over time. GRAIL Pass does not guarantee sales, marketplace placement, homepage placement, collection placement, rewards, exposure, impressions, or any specific business outcome; it provides only the opportunity to receive applicable membership benefits while eligible under the then-current program terms.

GRAIL may determine that certain transactions, users, products, promotions, or behaviors are not eligible for rewards.

Users who abuse the rewards system may have:

  • Rewards revoked.
  • GRAIL Credit removed.
  • Trust Score reduced.
  • Marketplace privileges restricted.
  • Accounts suspended or terminated.

Repeated attempts to manipulate the rewards system may result in permanent removal from GRAIL.

14. Trust Score

Trust Score is an internal marketplace reputation system designed to promote trustworthy buying and selling behavior.

Trust Score may consider numerous marketplace behaviors, including:

  • Order completion.
  • Shipping performance.
  • Seller cancellations.
  • Buyer payment reliability.
  • Dispute history.
  • Marketplace policy violations.
  • Fraud investigations.
  • Other marketplace integrity factors.

The exact Trust Score calculation is proprietary.

GRAIL may update the Trust Score methodology at any time.

Users may not attempt to artificially manipulate Trust Score through coordinated activity, multiple accounts, sham transactions, or any other deceptive practice.

15. Fraud, Abuse, and Marketplace Manipulation

GRAIL is committed to maintaining a safe, fair, and trustworthy marketplace.

Any activity intended to deceive, manipulate, exploit, or otherwise undermine the integrity of the Platform is strictly prohibited.

Examples include, but are not limited to:

  • Creating multiple accounts to gain rewards or promotional benefits.
  • Creating fake transactions.
  • Artificially inflating marketplace activity.
  • Coordinating purchases between related accounts.
  • Shill bidding.
  • Fake offers.
  • Bid manipulation.
  • Listing manipulation.
  • Market value manipulation.
  • Circumventing marketplace fees.
  • Payment fraud.
  • Chargeback abuse.
  • Identity fraud.
  • Selling counterfeit or knowingly altered items.
  • Misrepresenting card condition.
  • Misrepresenting authenticity.
  • Manipulating Trust Score.
  • Manipulating GRAIL Credit.
  • Manipulating rewards.
  • Exploiting bugs or unintended system behavior.
  • Using automation, bots, or scripts to gain an unfair advantage.
  • Attempting to interfere with GRAIL systems or security.

Attempting to abuse the Platform may result in immediate enforcement action.

16. Disputes

If a disagreement arises between buyers and sellers, GRAIL may review the transaction.

Users agree to cooperate fully during any investigation.

GRAIL may request:

  • Photographs
  • Videos
  • Tracking information
  • Shipping documentation
  • Communication history
  • Proof of ownership
  • Purchase records
  • Any other information reasonably necessary to investigate the dispute.

Failure to cooperate may affect the outcome of the review.

17. Marketplace Review Authority

To maintain marketplace integrity, GRAIL reserves the right to review transactions, listings, disputes, cancellations, rewards, and account activity.

After reviewing available evidence, GRAIL may determine the outcome that it reasonably believes best protects the integrity, safety, fairness, and operation of the Platform.

This may include, where appropriate:

  • Reversing rewards.
  • Removing GRAIL Credit.
  • Adjusting Trust Score.
  • Cancelling listings.
  • Restricting marketplace privileges.
  • Suspending accounts.
  • Terminating accounts.
  • Refusing future transactions.
  • Requiring additional verification.
  • Taking any other reasonable enforcement action consistent with these Terms and applicable law.

GRAIL will exercise this authority in good faith based on the information reasonably available at the time of review.

The fact that GRAIL reaches a decision does not necessarily indicate wrongdoing by any party.

18. Shipping and Delivery

Sellers are responsible for shipping purchased items within the timeframes established by GRAIL.

Sellers must:

  • Properly package items.
  • Use the shipping methods supported by the Platform where required.
  • Provide accurate shipment information.
  • Ship only the item that was purchased.

Purchasing or printing a shipping label does not, by itself, constitute shipment.

Shipment is considered to have occurred when the carrier accepts the package for transportation or when otherwise verified through the shipping process supported by GRAIL.

Buyers should inspect received items promptly.

Shipping delays caused by carriers, weather, natural disasters, government actions, or other circumstances beyond a seller’s reasonable control may affect delivery times.

19. Inspection Period

Certain purchases may include an inspection period after delivery.

During this period:

  • Buyers should inspect the item.
  • Buyers should report material issues promptly.
  • Sellers should remain available to cooperate if necessary.

Inspection periods begin when delivery is confirmed through the shipping process recognized by GRAIL.

The inspection period is intended to provide buyers a reasonable opportunity to identify issues before seller payouts are finalized.

Inspection procedures may change as GRAIL continues to improve the Platform.

20. Prohibited Items

Users may only list items permitted by GRAIL.

Prohibited content includes, but is not limited to:

  • Counterfeit items.
  • Stolen property.
  • Illegal goods.
  • Items prohibited by applicable law.
  • Fraudulent memorabilia.
  • Listings intended to deceive buyers.
  • Listings that infringe intellectual property rights.
  • Offensive or unlawful content.

GRAIL reserves the right to remove any listing at its sole discretion if it believes the listing may negatively affect marketplace integrity or user safety.

Listing removal does not prevent additional enforcement actions.

21. Account Suspension and Termination

GRAIL may suspend, restrict, or permanently terminate accounts for violations of these Terms.

Enforcement decisions may consider:

  • Severity of the conduct.
  • Frequency of violations.
  • Marketplace impact.
  • User cooperation.
  • Previous enforcement history.

Examples include:

  • Fraud.
  • Marketplace abuse.
  • Excessive seller cancellations.
  • Payment abuse.
  • Reward abuse.
  • Repeated inaccurate listings.
  • Counterfeit goods.
  • Harassment.
  • Circumvention of marketplace rules.

Termination may result in:

  • Removal of listings.
  • Loss of marketplace privileges.
  • Removal of rewards.
  • Removal of GRAIL Credit.
  • Trust Score adjustments.
  • Permanent loss of account access.

Where required by law or where appropriate, GRAIL may preserve transaction history, financial records, dispute records, and other information following account termination.

22. Marketplace Integrity & Administrative Authority

GRAIL is committed to maintaining a safe, trustworthy, and reliable marketplace for collectors.

To protect the integrity of the Platform, GRAIL reserves the right to investigate, review, suspend, restrict, delay, or reverse certain marketplace activities when reasonably necessary to protect users, enforce these Terms, comply with applicable law, or preserve marketplace integrity.

This authority may apply to, but is not limited to:

  • Listings
  • Purchases
  • Offers
  • Auctions
  • Rewards
  • GRAIL Credit
  • Trust Score
  • Seller payouts

  • Auction manipulation
  • Seller misconduct
  • Buyer misconduct

GRAIL may request additional information or documentation before allowing a transaction, reward, payout, account, or listing to continue.

Users agree to cooperate with reasonable investigations conducted by GRAIL.

Failure to cooperate may result in enforcement actions.

Nothing in these Terms requires GRAIL to immediately release rewards, GRAIL Credit, seller payouts, or other marketplace benefits while an investigation is ongoing.

Where appropriate, GRAIL may temporarily delay marketplace actions until sufficient information has been reviewed.

Any enforcement action taken by GRAIL will be based upon the information reasonably available at the time and will be exercised in good faith to protect the Platform, its users, and the integrity of the marketplace.

23. Intellectual Property

The GRAIL Platform, including its name, logos, trademarks, branding, software, designs, graphics, text, layouts, marketplace systems, rewards systems, Trust Score system, and other proprietary content are owned by GRAIL Collectibles LLC or its licensors.

Except as expressly permitted by GRAIL, users may not:

  • Copy
  • Modify
  • Distribute
  • Reverse engineer
  • Reproduce
  • Republish
  • License
  • Sell
  • Commercially exploit

any portion of the Platform.

Users retain ownership of the content they submit, including listing photographs and descriptions, but grant GRAIL a worldwide, non-exclusive, royalty-free license to host, display, reproduce, modify for formatting purposes, promote, and distribute that content in connection with operating and marketing the Platform.

This license ends when the content is permanently removed from GRAIL, except where retention is necessary for completed transactions, legal obligations, fraud prevention, or dispute resolution.

24. Third-Party Services

GRAIL integrates with third-party services that help operate the marketplace.

These may include payment processors, shipping providers, pricing providers, authentication providers, cloud hosting providers, analytics providers, and other service providers.

Examples may include:

GRAIL continuously improves the Platform.

Features may be:

  • Added
  • Modified
  • Removed
  • Replaced
  • Temporarily disabled

without prior notice.

GRAIL does not guarantee uninterrupted availability.

Maintenance, upgrades, security updates, third-party outages, and unforeseen technical issues may temporarily affect Platform availability.

26. Platform Errors

GRAIL reserves the right to correct technical errors, pricing errors, display errors, listing inaccuracies, software issues, or other platform errors when reasonably necessary to maintain marketplace integrity.

Corrections may include adjusting displayed information, pausing listings, canceling affected offers or transactions where appropriate, or taking other reasonable action consistent with GRAIL’s buyer protection, dispute, and marketplace-integrity policies. Nothing in this section is intended to weaken buyer protections or dispute rights provided elsewhere in these Terms or applicable GRAIL policies.

27. Force Majeure

GRAIL shall not be responsible for any delay, failure, interruption, or inability to perform caused by events beyond GRAIL’s reasonable control, including internet outages, cybersecurity incidents, infrastructure failures, government actions, carrier disruptions, natural disasters, labor conditions, third-party service failures, or other events beyond GRAIL’s reasonable control.

Where such events affect transactions or marketplace operations, GRAIL may take reasonable steps to protect users and maintain marketplace integrity.

28. Limitation of Liability

Nothing in these Terms limits liability that cannot legally be excluded under applicable law.

29. Indemnification

You agree to defend, indemnify, and hold harmless GRAIL Collectibles LLC, its affiliates, employees, officers, contractors, licensors, and partners from any claims, damages, liabilities, costs, losses, and expenses, including reasonable attorneys’ fees, arising from:

32. Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.

Any invalid provision shall be interpreted or modified only to the extent necessary to make it enforceable while preserving its original intent as closely as possible.
